Please read these Terms of Service ("Terms") carefully before using the Quit Clock mobile application (the "App") operated by Quit Clock ("us", "we", or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

1. Accounts

When you create an account with us, you must provide us with accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Subscriptions (CRITICAL - REQUIRED BY APPLE)

2.1 Premium Subscription Service

Quit Clock offers a premium subscription service ("Quit Clock Premium") that provides enhanced features.

2.2 Subscription Terms

By purchasing a subscription, you agree to the following terms:

• Subscription Type: Auto-renewable monthly subscription
• Price: $5.99 USD per month (plus any applicable taxes)
• Payment: Payment will be charged to your Apple ID account at confirmation of purchase
• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Account Charging: Your account will be charged for renewal within 24 hours prior to the end of the current period
• Renewal Cost: Renewal cost will be the same as the original subscription price

2.3 Free vs Premium Features

• Free Users: Limited to tracking 3 substances, limited AI messages (5 daily base + 2 per ad watched)
• Premium Users: Unlimited substance tracking, unlimited AI messages

2.4 Subscription Management

You can manage and cancel your subscriptions at any time by:

1. Going to your device's Settings
2. Tapping on your Apple ID at the top
3. Selecting "Subscriptions"
4. Finding "Quit Clock Premium"
5. Turning off auto-renew or canceling your subscription

2.5 Cancellation and Refunds

• Cancellation: You may cancel your subscription at any time
• Continued Access: After cancellation, you will continue to have access to premium features until the end of your current billing period
• No Refunds: All sales are final. Apple handles all payments and refunds through their standard refund policy
• Refund Requests: For refund requests, contact Apple Support directly

2.6 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect current subscriptions and will only apply to subsequent renewal periods.

2.7 Free Trial

Currently, Quit Clock does not offer a free trial period. This may change in the future, and any free trial terms will be clearly disclosed at the time of offering.

3. Content

Our App allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material. You are responsible for the content that you post on or through the App, including its legality, reliability, and appropriateness.

3.1 Community Guidelines

When using the community features:

• Be respectful and supportive of others
• Do not share personal information
• Do not promote substance use or harmful behaviors
• Do not spam or advertise

We reserve the right to remove any content that violates these guidelines.

4. Prohibited Uses

You may use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App
• To attempt to bypass or circumvent any subscription limitations
• To use automated means to access the App or create accounts

5. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Quit Clock and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Quit Clock.

5.1 User-Generated Content

By posting content to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, publicly display, and distribute your content for the purpose of operating and improving the App.

6. Links To Other Web Sites

Our App may contain links to third-party web sites or services that are not owned or controlled by Quit Clock.

Quit Clock has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Quit Clock shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or delete your account.

7.1 Effect of Termination on Subscriptions

If your account is terminated for violation of these Terms, your subscription will be canceled immediately without refund. If you voluntarily delete your account, your subscription will continue until the end of your current billing period.

8. Limitation Of Liability

Important Disclaimer: Quit Clock is designed to support habit tracking and provide motivational information. It is not a substitute for professional medical advice, diagnosis, or treatment.

In no event shall Quit Clock, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

8.1 Health Disclaimer

The health and wellness information provided in the App is for educational and motivational purposes only. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

9. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

9.1 No Guarantee of Results

Quit Clock does not guarantee that using the App will result in successfully quitting any substance or habit. Success depends on individual commitment, circumstances, and various factors beyond our control.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

10.1 Continued Use

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the App.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
